By using ShareMyScene.com, you agree that any disputes will be resolved through binding arbitration and not in court.
All arbitration will be administered by National Arbitration and Mediation (NAM) under its Comprehensive Dispute Resolution Rules and Procedures. The arbitration will be conducted by a single arbitrator, virtually via Zoom or a similar platform. If a virtual proceeding is not possible, arbitration will occur in Los Angeles, California, unless otherwise agreed.
Class action lawsuits, class-wide arbitrations, and jury trials are not permitted. Each dispute will be handled on an individual basis. You waive your right to participate in any class action or representative action.
You may pursue individual claims in small-claims court if eligible and if you notify us within 60 days of the dispute arising.
Batch Arbitration: If 25 or more similar claims are filed within a 90-day period by the same or similar counsel, those will be grouped and resolved in Batches of up to 50 claimants, with one arbitrator assigned to each Batch, unless otherwise determined.
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws principles. Venue for any permitted court action shall be in Laramie County, Wyoming.
We may update these Terms from time to time. We will post changes to the Website and update the effective date. Continued use of the Website after changes constitutes your acceptance of the revised Terms.
You may not assign or transfer your rights or obligations under these Terms without prior written consent. We may assign our rights and obligations freely.
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision shall not constitute a waiver of that provision.
